The city has initiated legal action to evict the residents. Lawyers at the Wits Legal Clinic are opposing the evictions in terms of the National Buildings Regulation Act. They advise that eviction should rather be sought under the Prevention of Illegal Eviction from and Unlawful Occupation of Land Act which, they submit, was promulgated to give effect to a person's constitutional right to housing, and as a consequence requires the provision of alternative accommodation to evicted residents. So far, the city has taken no further steps to execute the eviction order.
