Although the Building Standards Act is invoked, it is unconstitutional to evict someone from their home without a court order. So after a notice under the Building Standards Act is issued, the municipality lodges an application with the High Court for an interdict ordering the occupiers to vacate and not reoccupy without the municipality's written permission. Framed as a temporary measure, the interdict, once granted, is the same as permanent eviction.
